The principle of independence and impartiality of arbitrators is essential for due process. Ruling of the Regional Court in Žilina [SVK], file No. 8 Co/97/2013, dated 30 August 2013

This case concerned a dispute between a cooperative society (claimant) and an individual (respondent) regarding the annulment of an arbitral award. Firstly, the court had to decide on its jurisdiction to hear the case. The respondent objected to the Slovak court’s jurisdiction on the basis that the place of arbitration was in Bosnia and Herzegovina and, consequently, Slovak courts were not entitled to set aside foreign arbitral awards.
