Theoretical Considerations of the Interaction of International Arbitrations and Courts in International Law

ABSTRACT:

The proliferation of international courts and tribunals has been one of the most evident trends in international law development and has had a pronounced effect on the evolution of international justice since the last quarter of the 20th century. International courts and arbitration tribunals interact by means of mutual reliance on legal positions formulated earlier resulting in the emergence of a foundation of the system of international courts and arbitration tribunals – their common jurisprudence. The highest authority on issues of general international law is ascribed to the decisions of the Permanent Court of International Justice and the International Court of Justice. This trend is most convincingly manifested in international investment arbitration awards.
